Keeping It Real: AI Sales Calls and the Law

AI voice tools are everywhere. So are the legal traps. Here’s what B2B sales teams need to know.

In February 2024, the FCC ruled that AI-generated voices are “artificial” under the TCPA — meaning they’re legally classified as robocalls. That applies to business numbers too. Unsolicited AI cold calls are now illegal, full stop, and the penalties are steep: $500–$1,500 per call at the federal level, up to $10,000 per violation in states like Texas, and class-action exposure for large campaigns.

What You Must Do
• Get written consent: Before using AI on outbound calls to mobile or residential lines.
• Disclose immediately: The AI must identify the business and purpose at the start of the call. Texas requires this within 30 seconds.
• Provide easy opt-out: Honor requests within 10 business days.
• Scrub DNC lists: Both the National Registry and your internal list.
• Respect time zones: No calls before 8 a.m. or after 9 p.m. local time.

Where AI Actually Works
• Inbound callbacks: A prospect who filled out your form has given consent. Call them back immediately with AI.
• Parallel dialing: AI dials, a live human takes over the moment someone answers.
• Behind the scenes: Lead scoring, call coaching, and follow-up drafting carry none of the same regulatory risk.

AI in B2B sales isn’t illegal — unconsented AI cold calling is. The rules are real, enforced, and getting stricter. Get legal counsel before you launch. The cost of getting it wrong is far higher than the cost of getting it right.
